These terms and conditions apply to the sale of products by Château Giscours in the store accessible via the internet and by telephone. They are made available to the purchaser automatically on the homepage of the Château Giscours website.
The purchaser simply needs to click on ‘terms and conditions of sale’ (hereinafter T&Cs) to view the terms and conditions for their order, which they can do before beginning the order process.
As a result, the act of placing an order implies full and unconditional acceptance of these T&Cs, excluding all other documents such as flyers or catalogues sent by the seller which are indicative only.
The fact that the seller does not cite one of these general terms and conditions at a given time may not be interpreted as a waiver of the right to cite any such conditions at a later date.
Our offerings are reserved exclusively for private individuals.
Orders are confirmed by sending an order confirmation email, but are not definitive until payment is received in full.
Access to website:
Once the Customer has accessed the Website, they can select the Product(s) that they wish to order and place it/them in their shopping cart, which is on the right-hand side of the screen. They can remove Products from their cart or change Product quantities at any time by clicking on the relevant buttons. Once they have selected their chosen Product(s), the Customer can check out their cart by clicking on ‘PROCEED TO CHECKOUT’. By clicking this button, the Customer acknowledges and expressly waives their entitlement to the benefits of Article 1587 of the French Civil Code.
Final order process:
A summary of the order is shown on the screen. At this stage, the Customer can still remove Products from their cart or change Product quantities at any time by clicking on the relevant buttons. The Customer must click on the ‘PLACE ORDER’ button to confirm the order. By clicking this button, the Customer expressly acknowledges that they are required to pay the total order amount in order to receive delivery. The Customer is then invited to agree to these terms and conditions of sale by ticking the box at the bottom of the screen and clicking ‘CONFIRM PAYMENT’. By clicking this button, the Customer is committing to pay for the order.
Order confirmation:
Once the order has been confirmed, the Customer will receive an order confirmation email sent to the address given when they set up their account. This email will confirm the key points of the order, in particular the product(s), the price(s) of the product(s), delivery times, and delivery methods. This email will also summarise the payment methods and the conditions under which the Customer may exercise their right of withdrawal.
Indication:
Prices are given in euros (€). They are given inclusive of VAT, excluding shipping costs. Subject to typographical or display errors or obvious pricing errors.
Billing:
Billing: a detailed invoice is available upon request. Invoices are issued in euros (€). All bank payments are made in a choice of either euros (€) or local currency.

The price of the items ordered is payable in full to SE Château Giscours once your purchase order is issued on the website, using one of the following payment methods:

We have set up a secure process for paying by bank card online. This process uses data encryption technology, the benchmark for secure payment.
How do you pay by bank card on the website?
When you pay, you enter your card number and expiration date, which are immediately encrypted on your computer before being transmitted online. This means that no confidential information will circulate on the network without being encrypted beforehand.
NB: only CB, VISA, EUROCARD, MASTERCARD and AMERICAN EXPRESS cards are accepted.
Goods are transported at your cost and risk. Once the customer has accepted a delivery, they may no longer report a breakage or other problem. It is therefore your responsibility to check the contents of the package when it is delivered and to submit any objections if relevant, as follows:

And also, in any case, by informing Château Giscours by registered letter addressed to our head office (10 Route de Giscours, 33460 Labarde) within three (3) days of receiving the package.
In the event of a breakage or damage when preparing the order or during delivery, Château Giscours will take the necessary steps to re-deliver, or otherwise to refund the amount paid for the order.
Until the actual payment is made in full, Château Giscours remains the owner of the goods being sold. Payment in full triggers the transfer of ownership, however the purchaser becomes responsible for the items upon delivery, as the transfer of possession triggers the transfer of risk.
In the event of non-payment by the customer within the agreed deadline and a month after a formal notice has been provided with no result, the sale will be cancelled ipso jure if the seller deems fit, with the refund of any deposits paid by the purchaser, and where relevant the option for the seller to also request the return of any products already delivered, without prejudice to any other damages or interest. In the event of a recovery by legal means, an inclusive payment corresponding to 15% of the amount of the order will be applied.
Right of access and rectification:
In order to meet your needs and provide optimal remote service, we are required to record certain elements pertaining to you (full name, address, date of birth).
You may receive communications from Château Giscours containing Château Giscours offerings by telephone, post or email.
If you do not wish to receive these, simply write to our customer services giving your full name and address, or change the information relating to you on the page ‘Your shopping cart’.
Pursuant to the French Data Protection Act of 6 January 1978, you have a right to access and rectify recorded data.
You can also rectify this data by contacting our customer services.
Bank details:
Furthermore, any bank details that you communicate to us whilst placing an order online will not be stored or be visible online. No-one can intercept the information that you send.
A bill that is unpaid due to the fraudulent use of a bank card will result in the details from your order being recorded and linked to this unpaid bill. An inaccurate declaration or anomaly may also be subject to special treatment.

Contract concluded by a French consumer from France
This contract is subject to French law. Any disputes arising from the execution or interpretation of this contract will be subject to the jurisdiction where the defendant is resident or at the place of delivery.
In accordance with article L. 3342-1 of the French Public Health Code, which stipulates that sale of alcohol to minors under the age of eighteen (18) is prohibited, when completing the order form you confirm that you are aged eighteen (18) or over on the date of the order by ticking the relevant box.
